Virginia Trans-Prostitute Formally Charged in Oklahoma with felony crimes. Kimmie Huynh Posts HIV Test Results

12/26/2017 - OKC, OK -- A high profile Virginia Beach transvestite, previously arrested in Oklahoma City and accused of "spreading infectious diseases", has been formally criminally charged in Oklahoma County with prostitution related crimes. The defendant also recently posted alleged results of a HIV test, but continues to ignore allegations of herpes infection.

As originally reported by JohnTV, Kimmie Kim Huynh (born a male named Vuong Thien Gia Huynh) was arrested on Dec. 6, 2017 on criminal complaints of; causing spread of infectious diseases, offering to engage in prostitution, possession of criminal proceeds, and unauthorized use of a computer.

Huynh, 29, was specifically targeted by Lt. Kimberlin with the Oklahoma City Vice Enforcement Unit after authorities allegedly received a telephone call from an unidentified individual who claimed "[Kimmie] was involved in prostitution in OKC and was infected with HIV virus. [sic]."

According to Lt. Kimberlin's probable cause affidavit (see below), he responded to the prostitution ad Kimmie posted to back page.com and was directed to room #215 of the Springhill Suites by Marriott at 600 E. Sheridan Ave. in downtown OKC.

Once Lt. Kimberlin arrived he claims that the conversation quickly turned to sex. Kimmie then reportedly "agreed to permit me (Lt. Kimberlin) to perform oral sex on him/her, to completion, for $300."

At that point additional officers arrived on scene and Kimmie was taken into custody.

Lt. Kimberlin reported that "during the contact with [Kimmie], he/she volunteered information that he/she has herpes, which is contagious in a sexual encounter."

According to Kimmie's mugshot, he was originally booked into the Oklahoma County Jail, as a male, on the criminal charges listed previously in this article.

However, the Oklahoma City Police Department's booking information shows a slight (but significant) variation to the criminal complaints. That public document, which uses Kimmie's male name, lists the criminal complaint of "trans[mitting] AIDS." See actual public document below...

It is important to note that nowhere in Lt. Kimberlin's affidavit does it mention HIV, beyond the initial telephone call they claim to have received.

Kimmie was released from jail several days later after posting bond.

Upon his release, Kimmie reportedly returned to Virginia Beach and sent a message to his friends on Facebook. That message asserted that he is "HIV negative" and that he was never tested by the police or the sheriff's department who runs the jail.

Kimmie also claims that, prior to his arrest, he and Lt. Kimberlin were both naked, that he had a condom on his penis and that Lt. Kimberlin was about to perform oral sex upon him.

Kimmie also posted what appears to be the results of an HIV test that he had performed after being released from jail. The posting came with an eloquent introduction... that basically said his haters "can eat my siht" - JohnTV wonders how much she charges her customers for that?

For undisclosed reasons, Kimmie has yet to publicly address the herpes claim.

However, when formal charges were filed, prosecutors elected not to pursue the "spreading infectious diseases" claim made by Lt. Kimberlin.

The reason for this has not been publicly acknowledged by the Oklahoma County District Attorneys Office. JohnTV has been told there are several reasons why the spreading of infectious diseases allegation was probably not pursued. For one, the probable cause affidavit provides no proof Kimmie is in fact infected with any sexually transmitted disease. The claim of HIV came from a third-party and may very well have been from someone with a grudge against Kimmie who was willing to lie. Kimmie's alleged self-disclosure of herpes is not enough to warrant charges and secure a conviction. One lawyer we spoke to even suggested that possibly Kimmie's admission of herpes infection came during the negotiation for commercial sex and not after her arrest. If true, then her disclosure to any potential 'johns' means she cannot be charged with a crime because she is admitting to infection upfront. Lastly, law enforcement would be unable to force Kimmie to be tested for any diseases unless he were to be convicted of a crime and sentenced to incarceration or as part of a plea deal. Lastly, if Kimmie's version of events is true - that he was prepareed to wear a condom during fellatio - then the risk of herpes (or even HIV) transmission to a sexual partner is extremely low.

Regardless, JohnTV, the police dept., nor the prosecutors office has any idea what Kimmie's true health status is when it comes to STD's. 

Approximately 30-minutes before Kimmie posted a copy of his HIV test results, he also posted a status claiming "To All My Haters... CHARGES GOT DROPPED. #MerryChristmas"

Well, that post is not true at all. 

Criminal charges were filed on Dec. 18 and none of those charges have been dropped, as of this original posting.

Maybe Kimmie was referring only to the criminal complaint of "spreading infectious diseases." However, since that complaint never resulted in charges, it couldn't very well have been "dropped."

Based on the actual charges that were filed, JohnTV predicts this case will end like so many others... Kimmie will eventually take a plea deal that will result in either a deferred or suspended sentence. Most likely the felony computer crimes charge will be dropped and if Kimmie hires a competent lawyer, he will take a plea that allows him to be eligible for an eventual expungement of the entire ordeal.
